Terms of Service

IMPORTANT: READ THIS TERMS OF SERVICE AGREEMENT ("AGREEMENT") BEFORE AGREEING TO USE THE SERVICE PROVIDED BY DATAMONAD LLC. ("THE COMPANY", "WE", "US", "OUR"). IF YOU DO NOT AGREE WITH ANY OF THE TERMS IN THIS AGREEMENT, DO NOT ACCESS THE SERVICE. IF YOU DO NOT AGREE WITH THE TERMS OF THIS AGREEMENT, YOU WILL NOT BE ABLE TO USE THE SERVICE. THIS AGREEMENT IS A BINDING AGREEMENT BETWEEN DATAMONAD LLC. AND THE COMPANY OR OTHER LEGAL ENTITY TO WHICH THE SERVICE DESCRIBED HEREIN IS MADE AVAILABLE ("YOU" or "USER").

YOUR USE OF THE SERVICE SHALL BE DEEMED TO BE YOUR AGREEMENT TO ABIDE BY EACH OF THE TERMS SET FORTH BELOW. YOU ACKNOWLEDGE AND AGREE THAT, BY ACCESSING OR USING THE SERVICE, YOU ARE INDICATING THAT YOU HAVE READ AND AGREE TO BE BOUND BY THE TERMS CONTAINED HEREIN. IF YOU DO NOT AGREE TO THESE TERMS, THEN YOU HAVE NO RIGHT TO ACCESS OR USE THE SERVICE.

SERVICE

Subject to User's compliance with the terms of this Agreement, we grant User a non-exclusive, non-transferable right to access and use its Service for using certain User-supplied data, solely for use by User. The Service may consist of: (a) managing data feeds provided by User, and (b) analyzing such data and making available to User the results of such analyses in the form of files.

TERMINATION

We may terminate or suspend Your access immediately, without prior notice or liability, for any reason whatsoever, including without limitation if You breach these Terms. Upon termination, Your right to use the Service will cease immediately.

PROHIBITED ACTIVITIES

You may not use the Service for any purpose other than that for which we make the Service available. The Service may not be used in connection with any commercial endeavors. As a user of the Service, you agree not to:

• Attempt to bypass any measures of the Service designed to prevent or restrict access to and abuse of the Service.
• Engage in abusing the Service, such as transmitting unnecessarily excessive amounts of data and transmitting data inappropriately often, or any automated use of the Service, such as using scripts to send data.
• Circumvent or interfere with security-related features of the Service.
• Except as permitted by applicable law, decompile, disassemble, or reverse engineer any of the software comprising the Service.

LIMITATIONS OF LIABILITY

IN NO EVENT WILL WE OR OUR EMPLOYEES BE LIABLE TO YOU OR ANY THIRD PARTY FOR ANY DIRECT, INDIRECT, CONSEQUENTIAL, EXEMPLARY, INCIDENTAL, SPECIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFIT, LOST REVENUE, LOSS OF DATA, OR OTHER DAMAGES ARISING FROM YOUR USE OF THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

"AS IS" AND "AS AVAILABLE" DISCLAIMER

The Service is provided to You "AS IS" and "AS AVAILABLE" and with all faults and defects without warranty of any kind. To the maximum extent permitted under applicable law, the Company expressly disclaims all warranties, whether express, implied, statutory or otherwise, with respect to the Service, including all implied warranties of merchantability, fitness for a particular purpose, title and non-infringement, and warranties that may arise out of course of dealing, course of performance, usage or trade practice. Without limitation to the foregoing, the Company provides no warranty or undertaking, and makes no representation of any kind that the Service will meet Your requirements, achieve any intended results, be compatible or work with any other software, applications, systems or services, operate without interruption, meet any performance or reliability standards or be error free or that any errors or defects can or will be corrected.

Without limiting the foregoing, the Company makes no representation or warranty of any kind, express or implied: (i) as to the operation or availability of the Service, or the information, content, and materials or products included thereon; (ii) that the Service will be uninterrupted or error-free; (iii) as to the accuracy, reliability, or currency of any information or content provided through the Service; or (iv) that the Service is free of viruses, trojan horses, malware, or other harmful components.

USER REGISTRATION

You may be required to create an account before using the Service. If you create a password, you agree to keep your password confidential and will be responsible for all use of your account and password. We reserve the right to remove or reclaim a username you choose if we determine that such username is inappropriate.

USER DATA

We will maintain certain data that you transmit to the Service for the purpose of monitoring the Service for violations of these Terms of Service and preventing you from abusing the Service. You are responsible for any data that you transmit or that relates to any activity you have undertaken using the Service. You hereby waive any right of action against us arising from any loss or corruption of such data.

CHANGES TO THESE TERMS

We reserve the right, at Our sole discretion, to modify or replace these Terms at any time. By continuing to access or use Our Service after those revisions become effective, You agree to be bound by the revised terms. If You do not agree to any of the new terms, stop using the Service.
